Courts Deny Discrimination Appeal of Hispanic Contractors Association

The ruling said that a lawsuit isn't the proper forum to challenge affirmative-action policy violations.

The Missouri courts this week rejected the appeal of a Hispanic contractors association that in 2005 unsuccessfully sued H&R Block on charges of contracting discrimination, the Kansas City Star reported.

The case centered on a $138 million project: the construction of the company’s new 17-story headquarters in Kansas City. It opened in 2006.

The Kansas City Hispanic Association of Contractors Enterprise and contractor Diaz Construction Co. claimed that the company failed to meet its goal of ensuring that 15 percent of its sub-contractors were minority-owned businesses.

In a Tuesday ruling, the Missouri Court of Appeals agreed with a decision by the Jackson County Circuit Court that the Kansas City Hispanic Association of Contractors Enterprise and Diaz Construction did not have the grounds to file a lawsuit.

Lamb: What is your academic background? How did you become interested in the issues surrounding the landmark U.S. Supreme Court decisions on race, desegregation and education policy?

Wolters: I was educated at Stanford (B.A., 1960) and Berkeley (Ph.D., 1967) and have been a member of the faculty at the University of Delaware since 1965.

My special interest in school desegregation came about by chance.

In 1978-79 the federal courts ordered my county, New Castle County, DE, to implement one of the most wide-ranging of all of the plans of busing for racial balance. At that time, 90 percent of the students in Delaware’s biggest city, Wilmington, were black, and on standard tests the high school seniors in Wilmington were scoring at about the level of 8th grade students in the suburbs, where students were 90 percent white. The hope was that this “racial-achievement gap” would be reduced if students were bused so that the enrollment at each school in the county was about 80 percent white.

On May 17, 1954, the date of Brown v. Board of Education, the Supreme Court had decided five cases that presented a similar issue—not only the Brown case from Topeka, KS, but also cases from Wilmington, DE, Summerton, SC, Prince Edward County, VA, and Washington, D.C. As it happened, Wilmington had desegregated its schools immediately after Brown, but between 1954 and 1975 the racial balance in Wilmington’s public schools “tipped” from 73 percent white to only 9 percent white.

That led me to question the view that seemed to prevail in most books and articles. Most writers depicted desegregation as a great success, but the policy had not worked well in Wilmington. I wondered if the policy had also failed in the other places whose cases were decided on May 17, 1954.

What is Uhuru?

What is Uhuru and why has the “mainstream” media been hiding this group from you?

The so-called “Uhuru Movement” is known by multiple names, most commonly as the African People’s Socialist Party(APSP) or Uhuru. It is the group that organized a march and rally in Oakland celebrating the monster who murdered four police officers and is the prime suspect in another murder and the rape of a 12 year old girl.

Uhuru/APSP is one of several extremely militant anti-white groups thriving in black communities across the United States. Uhuru openly celebrates violence against white police and authority figures. They also denounce Obama as a tool of the “white power establishment.”

The group is based in St. Petersburg, Florida and actively holds rallies and demonstrations in about a dozen cities. The leader goes by the name “Chairman Omali Yeshitela.” The group claims a kinship with ZANU, the political party of violent Zimbabwe dictator Mugabe. It also claims to be allied with “revolutionary forces” in South Africa and other nations. Uhuru calls itself the “American front of the international African liberation movement.”

Europe Falls Out of Love with Labor Migration

With unemployment soaring, many European Union countries want the migrant workers they once attracted to go home as quickly as possible. They are sparing no expense or effort to encourage them to leave.

Chultem Choijusuren was watching television in Ulan Bator when he decided to climb aboard the globalization bandwagon. According to an ad he had seen, companies in the Czech Republic were paying young mechanics “€1,000 a month.” Most people in the Mongolian steppes were already familiar with the small Eastern European country. After all, many young people from here had studied in Prague during the two countries’ Socialist pasts.

Choijusuren borrowed the equivalent of €3,000 ($3,900) from local banks. Part of the money was to pay the €1,500 fee that the Mongolian employment agency was charging for securing him a job. He would also need some money to start life abroad, and the one-way train ticket from the Mongolian capital Ulan Bator to Prague, via Moscow, cost €700 ($910). His wife and eight-year-old daughter waved goodbye as the train left the station.

The Mongolian planned to stay in Europe for perhaps half a year, save a few thousand euros, and return home to open his own car repair shop.

Choijusuren is part of the army of migrants that has moved westward from developing countries in recent years, with one in three chosing Europe as their destination. After the European Union’s eastward expansion in 2004, tens of thousands of Asians found jobs in Polish, Czech and Slovak factories, where they were welcomed with open arms to fill the jobs that one million Poles and hundreds of thousands of Czechs, Balts, Slovaks and Hungarians had left behind when they in turn migrated to the wealthier EU countries. Ireland, Great Britain and Sweden, unlike Germany and Austria, had immediately opened their borders to citizens of the new member states, and Spain followed suit two years later.

Tiny Italian island figures large for migrants

"I treated 72 police officers and 24 migrants," said Laura Rizzello, a Red Cross nurse who has spent three years on Lampedusa. "The inmates were using everything as weapons: glass, the wreckage of window frames, doors as shields. They tore the place apart before they burned it."

Reporting from Lampedusa, Italy — The aging turboprop filled with a squad of blue-clad Italian riot police banks over the Mediterranean and descends onto a tiny, wind-swept island that emerges like an apparition from the turquoise waters near Tunisia.

Lampedusa has been a base for fishing fleets, an exile for radicals and Mafiosi, and a vacation spot in summer, when the population multiplies tenfold. Today, it is the border.

Like the U.S.-Mexico line, this island an hour’s flight south of Sicily has become a rampart between two worlds. Lampedusa, all 12 square miles of it, serves as a gateway to Europe for seagoing migrants who are smuggled, abused and exploited by criminals and, allegedly, officials in Libya, the main staging ground for the illicit journeys.

Last year, Italian security forces based here intercepted about 34,000 illegal immigrants on precarious vessels from Africa, double the number in the previous year. That human wave from the south has collided with a powerful counter-current: a Europe-wide move to fortify borders that has been intensified by the global economic meltdown.

In recent weeks, Italy announced tough measures against seagoing migrants, who account for 15% to 20% of illegal entrants.

Obama’s aunt back in Boston for deportation hearing

Critics, outraged that she is living in taxpayer funded public housing while thousands of citizens and legal immigrants are on waiting lists, are scrutinizing the case for political favoritism.

President Obama’s aunt, a Kenyan immigrant who ignited controversy last year for living in the United States illegally, has returned to her quiet apartment in a Boston public housing complex to prepare for an April 1 deportation hearing.

When her case emerged in the waning days of the presidential race last year, Zeituni Onyango, a tall, frail-looking woman in her late 50s who walks with a cane, fled the media attention to stay with relatives in Cleveland.

She attended Obama’s inauguration in January and, according to neighbors, returned to Boston a few weeks ago for her third attempt to fight removal from the United States. She had been living in the country illegally since she was ordered deported in 2004.

Onyango is a half-sister of the president’s late father, Barack Obama Sr., who was absent most of Obama’s life and who died in a car accident in 1982. The president met his aunt during a trip to Kenya and included her in his 1995 memoir, “Dreams from My Father,” but has said he was unaware of her immigration issues.

Now the woman Obama called “Auntie Zeituni” is in a national spotlight, where she is being seen as a test for the president’s commitment to enforcing immigration laws.

Oakland Killer Had Just Been Linked to Rape

Oakland police had also considered Mixon a suspect in the December 2007 slaying of Ramon Stevens, 42, who was shot and killed on the street near the corner of 86th Avenue and International Boulevard. Mixon was detained on a parole violation in February 2008, but homicide investigators could not make a case.

The day before Lovelle Mixon unleashed a barrage of gunfire that killed four Oakland police officers, the department’s investigators learned that DNA evidence had linked the fugitive parolee to an unsolved rape this year, authorities said Monday.

The possibility that Mixon feared being arrested for rape is a key factor for investigators trying to understand why the 26-year-old Oakland man opened fire on two motorcycle officers who pulled him over for a traffic stop Saturday afternoon at 74th Avenue and MacArthur Boulevard.

Witnesses said Mixon stood over the wounded officers, Sgt. Mark Dunakin, 40, and Officer John Hege, 41, and fired at least one round into each with a handgun before fleeing on foot to his sister’s apartment half a block down 74th, acting Police Chief Howard Jordan said.

Although the reason for the traffic stop isn’t known, Jordan said witness accounts indicate that Dunakin, possibly suspicious of what turned out to be a fake driver’s license, motioned to Hege to remove Mixon from his car just before Mixon opened fire.

When SWAT officers, acting on a tip, later stormed the nearby apartment, Mixon opened fire with an AK-47 assault rifle, killing Sgt. Ervin Romans, 43, and Sgt. Daniel Sakai, 35, and wounding Sgt. Pat Gonzales before other officers shot him to death.

UK population must fall to 30m, says Porritt

Phil Woolas, the immigration minister, said: “You can’t have sustainability with an increase in population.”

JONATHON PORRITT, one of Gordon Brown’s leading green advisers, is to warn that Britain must drastically reduce its population if it is to build a sustainable society.

Porritt’s call will come at this week’s annual conference of the Optimum Population Trust (OPT), of which he is patron.

The trust will release research suggesting UK population must be cut to 30m if the country wants to feed itself sustainably.

Porritt said: “Population growth, plus economic growth, is putting the world under terrible pressure.

“Each person in Britain has far more impact on the environment than those in developing countries so cutting our population is one way to reduce that impact.”

Population growth is one of the most politically sensitive environmental problems. The issues it raises, including religion, culture and immigration policy, have proved too toxic for most green groups.

However, Porritt is winning scientific backing. Professor Chris Rapley, director of the Science Museum, will use the OPT conference, to be held at the Royal Statistical Society, to warn that population growth could help derail attempts to cut greenhouse gas emissions.
